General Terms and Conditions of Sale

The site is the property of Tropical Influences in its entirety, as well as all related rights. Any reproduction, whether in whole or in part, is systematically subject to the authorization of the owners. However, hypertext links to the site are allowed without specific requests. We reserve the right to make changes to our procedures and conditions, including these terms of sale and use, at any time.

1- Acceptance of the terms by the client

Thank you for carefully reading these terms. The client acknowledges having read them before placing an order and expressly declares acceptance without reservation. These terms and conditions of sale govern the contractual relationship between Tropical Hamac and its client, both parties accepting them without reservation. These general terms and conditions of sale shall prevail over any other terms appearing in any other document, except in the case of a prior, express, and written waiver.

2- Articles

The photographs illustrating our articles are not part of the contractual agreement.

Tropical Influences Indeed, it cannot guarantee a unique output on all the computer hardware available on the market.

3- Order – delivery

An order confirmation is sent by email as soon as it is received, and we ship it within 24 to 48 hours. You have the option to modify or cancel your order until it begins processing. Please note that all our items are available in stock in our warehouses. Your invoice will be available in PDF format in your "my account" section.

We work exclusively with the carrier DPD France for all parcels up to 30 kg. Delivery to pickup points is available for all parcels with a maximum weight of 20 kg. Please note, the retention period for your parcels is between 8 and 10 days (depending on the pickup point). Delivery times are 24 to 48 hours depending on your delivery area. (During May 2017, 58% of our shipments were delivered within 24 hours, 34% within 48 hours, 4% within 72 hours, and 4% within 96 hours. July 2017: 24h/67%, 48h/24%, 72h/3%, 96h/6%). Parcels over 30 kg are shipped by Geodis/Calberson via freight service (delivery time 3 to 5 days). Tracking links are sent by email or SMS as soon as the parcel is dispatched.

TROPICAL HAMAC cannot be held responsible for delivery delays due to the unavailability of the customer or delivery delays caused by force majeure or events making delivery difficult or impossible, even if specific delivery dates have been set. Deliveries to countries within the EEC are carried out by DPD Europe. All information is provided to enable tracking of each package. The carrier also sends numerous emails (which may sometimes be found in spam folders). It is the recipient's responsibility to monitor the delivery of their package. If there is a delay, please contact us and we will take the necessary steps on your behalf.

Before signing the delivery slip, unpack and inspect your product in the presence of the delivery person. (No claims / no recourse, valid claims / possible exchange) Please note that the phrase "subject to unpacking" is not a valid claim. Properly note your claims on the delivery note, detailing any damages you observe, and contact us at 0559931052; we will inform you of the steps to follow with the carrier. If no specific claims are made on the delivery slip, you acknowledge having received a delivery that complies with your order and is in good condition.

The refusal of the goods, in the absence of specific reservations on the delivery note, as well as an unclaimed or returned package, will be considered as a cancellation of your purchase in accordance with the right of withdrawal. (see the right of withdrawal paragraph). Refusing a package due to late delivery is not an acceptable reason. In this case, all costs will be borne by the customer.

Mainland transport rate:

At a pickup point for any parcel up to 20 kg: contribution to shipping costs: €6.90 including tax (for parcels over 20 kg, home delivery is the only option)

Home delivery for any package up to 30 kg: €8.90 including tax.

Beyond 30 kg: contribution to shipping costs: €19.90 including tax

Overseas transport rates (Dom-Tom):

Shipping costs apply when you enter your address on the order form and amount to €19.90 including tax for a package with a maximum weight of 3 kg.

Operator: La Poste, delivery time 5 to 8 days.

CEE transport rate:

Shipping fees apply when you enter your address on the order form and are €15.90 including tax for a package with a maximum weight of 3 kg; €25.90 for 3 to 6 kg; €29.90 for 6 to 20 kg; €35.90 for 20 to 30 kg.

Operator: DPD, delivery time 5 to 10 days.

 

Deliveries to remote locations.

Some addresses are remote, little known, or quite difficult to access. The most efficient carrier in these cases is La Poste since they visit you every day and the mail carrier often knows you well (long live public service!). In such cases, do not hesitate to contact us (05 59 93 10 52) to explain your needs. We will ship your package via La Poste (with no extra charge) even if we have to go queue at our local post office. We prefer to do everything possible to ensure the delivery is successful.

4- Price and availability

Prices are expressed including all taxes in Euros. If any items you have ordered are out of stock, we will inform you as soon as possible either by email or by phone and we will refund you for these products.

5- Payment

Payment is made either by credit card in secure mode using the "Paybox" service from Crédit Agricole (we do not know your credit card number, and Crédit Agricole informs us of the details of your order) or by check via mail. At each stage of processing your order, during order placement and then at shipment, an email is automatically sent to the customer for real-time tracking. You can contact our Customer Service for any additional information. The equipment remains the full property of Tropical Influences until its full payment

6- Disputes

This contract is governed by French law. Tropical Influences cannot be held responsible for
responsible for damages of any kind, whether material, immaterial, or bodily,
Which could result from the use of the marketed articles and products. The responsibility of Tropical Influences will be limited to the amount of the order and cannot be held liable for simple errors or omissions that may occur despite all precautions taken to accurately present its products as well as their method of use. In case of difficulties in the execution of this contract, the buyer has the option, before any legal action, to seek an amicable solution, notably with the assistance of:
- of a professional association of the sector
- from a consumer association
- Any other advice of their choice.

It is reminded that seeking an amicable solution does not interrupt the "short period" of the legal warranty, nor the duration of the contractual warranty. It is also reminded that, as a general rule and subject to the courts' assessment, compliance with the provisions of this contract relating to the contractual warranty requires the buyer to fulfill their financial obligations towards the seller. Claims or disputes will always be received with attentive goodwill, good faith always being presumed in those who take the trouble to explain their situations.
In case of a dispute, the customer will first contact the company to obtain an amicable solution.
Failing that, the Commercial Court of Dax shall have sole jurisdiction, regardless of the place of delivery and the accepted method of payment.

7- Warranty

Our customer service department handles all requests immediately. We manage all warranties ourselves and do not rely on an external supplier. The warranty process is evaluated based on your issue (upon submission of photos). Only defects that prevent the use of a product will be covered. In all cases Tropical Influences will not be held responsible for non-compliance with the regulatory and legislative provisions in force in the country of receipt, the responsibility of Tropical Influences is systematically limited to the value of the product in question, valued at the date of sale. In any case, the customer benefits from the legal warranty against eviction and hidden defects (Articles 1625 and following of the Civil Code). Provided that the buyer proves the hidden defect, the seller is legally required to repair all the consequences (Articles 1641 and following of the Civil Code). However, note that the contract cannot be rescinded if the product has only a minor defect. If the buyer takes legal action, it must be done within a "short period" from the discovery of the hidden defect (Article 1648 of the Civil Code).

8- Legal Information

9 Right of withdrawal

Hamon Law: The Consumer Law extends the withdrawal period to 14 days without any reason, starting from the date you took possession of the item. You must notify us of your decision either by mail to TROPICAL HAMAC, 266 bis av Marcel Paul, 40220 Tarnos, or by email at contact@tropical-hamac.com

In all cases, the return must be made in its original packaging, and the product must be new, unused, and without signs of wear. Please note that you will be responsible for the return shipping costs and any depreciation in the value of the item resulting from handling. TROPICAL HAMAC will refund the contents of your order plus the delivery costs based on delivery to a pickup point. Please note that any additional reshipping fees are entirely your responsibility.

Refund within a maximum of 14 days upon receipt of the goods at TROPICAL HAMAC.
